内容提要：
本书从刑法解释面临的困境切入，引出刑法论证问题，第一张探讨了刑法论证方法的基础问题，以便为其后各章提供理论分析工具。第二至四章，分别就“视角切换”论证方法及刑法体系分析论证法、刑法的合宪性论证方法、刑法国际化论证方法、程序性论证方法及民刑关联论证方法，罪与刑之要素关联论证法、罪之要素关联论证法及刑之要素关联论证法等进行了梳理、归纳及评析。第五章则就刑法论证方法的综合运用问题进行了探讨。
